Birth tourism families could reap ‘never ending chain’ of Canadian citizenship abroad: critics

Proposed changes to the Citizenship Act have prompted concerns of a “never-ending chain of citizenship” for Canadians choosing to live abroad, including for the children of so-called birth tourists.

Bill C-71 is a proposed amendment to the Act that intends to allow Canadian citizenship to be continuously passed down by citizens who were born abroad and to their children who are also born abroad, as opposed to the current first-generation limit.

The chief caveat is that any person who is born abroad to a Canadian parent must have spent at least 1,095 days in Canada cumulatively in their lifetime, prior to having their child — what the Liberal government considers a “substantial connection” to the country.

There are no provisions to write a citizenship test or have an official language assessment.

“It is fraught with potential unintended consequences,” says Andrew Griffith, an immigration analyst and former director general for the Citizenship and Multiculturalism branch of Citizenship and Immigration Canada.

The bill was debated Monday in the House of Commons and is expected to head to committee; it is presently supported by the Liberals, New Democrats and Bloc Quebecois, but has faced questions from the Conservatives.

Among those questioning the proposed bill was Mission-Matsqui-Fraser Canyon MP Brad Vis, who raised the spectre of the bill further propagating the practice of birth tourism — visiting Canada on a tourist visa while pregnant for the purpose of giving birth and obtaining automatic citizenship for the child via “jus soli,” or “right of soil” laws in Canada.

Close to 1,000 birth tourists in B.C. prior to pandemic

Between April 1, 2019 and March 31, 2020, 868 non-residents of Canada, excluding temporary foreign workers, refugees and international students, paid to give birth in B.C. hospitals alone.

In B.C. those figures dropped significantly as a result of the pandemic and a diplomatic row with China.

“How is it just that a birth tourism baby would be able to pass citizenship on to their grandchildren under the proposed law? That is the big question today. Citizenship would be passed on to the grandchildren of Canadians born here solely for the purposes of obtaining citizenship. For my constituents, that is not just,” Vis said during debate in Ottawa.

“It is very clear that this pathway to citizenship is being abused; this program will only see the numbers increase as the Liberals reduce security checks for visitor visas as well,” said Vis, who otherwise supports the one-generation rule.

Both Griffith and Vis also have concerns about the 1,095 days spent in Canada not being cumulative, or within a prescribed period, such as the five years for a permanent resident application.

“This lack of a timeframe for meeting the critical requirement for passing on citizenship to descendants suggests the government has failed to fully consider the implications of such an open-ended condition,” said Griffith.

To summarize the example of a child of a birth tourist:

Under the current regime, the child born in Canada from parents visiting as tourists will go back to their parents’ country and decades later give birth to or adopt a child, who would become a Canadian citizen as well.

The path to citizenship for future generations born abroad would have ended there, however under the new regime that child can grow up and, as long as they spend 1,095 days in Canada for whatever reason, can have a child with Canadian citizenship bestowed upon them, and so on.

“The potential impact of Bill C-71 could be potentially large. So, before the government enshrines a new pathway to citizenship for some, all of the facts need to be properly considered,” said Griffith, who points out that media in India are characterizing Bill C-71 as legislation that “will open up the chain of citizenship without end, as long as the parents have spent at least 1,095 cumulative days.”

Griffith pointed out this new pathway is vulnerable to acts of foreign interference.

“It may also provide opportunities for longer-term sophisticated foreign-interference efforts by countries like China and India by exploiting descendants who can acquire Canadian citizenship in their recruitment strategies,” said Griffith.

That is a view previously shared by Michael Juneau-Katsuya, CSIS’s former chief of the Asia-Pacific.

Juneau-Katsuya told Glacier Media he sees birth tourism as a national security threat. He suggests the People’s Republic of China may document and monitor returning children and utilize them as agents of the communist state should they return to Canada as adults.

As such, the bill appears to extend this risk indefinitely, as streams of foreign-born Canadian families multiply exponentially (so long as they meet the 1,095 day requirement).

An alternative view of birth tourism has been presented by University of Carleton associate law professor Megan Gaucher, who was provided $223,328 from the Liberal government in June 2021 to research “how constructions of foreignness undermine the longstanding assumption that formal legal citizenship is an uncontested condition for membership to the Canadian state and explore how political and public discourse around birth tourism ultimately reproduces settler-colonial imaginaries of ‘good’ familial citizens.”

New law a ‘hybrid’ regime that could challenge gathering citizenship data: Griffith

The Canadian government does not appear to have a handle on how many Canadian citizens are living abroad and Griffith notes on his MulticulturalMeanderings.com column that “it will be challenging or impossible for the federal government to accurately predict citizenship acquisition year over year.”

Statistics Canada estimates between 2,953,500 and 5,549,800 Canadians live abroad. About half of those are citizens by descent, that is, they were born abroad to citizen parents from whom they obtained their citizenship. Citizens by birth born in Canada account for 35 per cent of those abroad while naturalized citizens account for 15 per cent of the diaspora.

The amendment stems from a December 2023 Ontario Superior Court ruling that the first-generation cut-off rule was unconstitutional.

Vis and the Conservatives have suggested the government should challenge the decision: “Our citizenship is something that is sacred. It is something that needs to be upheld, and a lower court decision should not be the determining factor on a matter of such importance as determining our citizenship,” Vis said.

Vancouver East MP Jenny Kwan noted the decision pointed out that “the judge accepted claims that women are particularly impacted because the second-generation cut-off rule discriminates on the basis of gender, forcing women in their reproductive years to choose between travel, study and career opportunities abroad or passing citizenship to their children.”

Griffith says the move expands “jus sanguinis” or the rights relating to blood.

“This change moves Canada closer to a hybrid jus sanguinis/jus soli regime, as it will make it possible for families to maintain intergenerational Canadian citizenship through different scenarios, which currently is not possible,” he said.

Griffith has long maintained Canada could tweak its jus soli rights by barring any passing of citizenship when neither parent has anything other than a tourist visa.

Berkeley business-owners are taking city rot into their own hands

Berkeley, Calif., once a bastion of liberal idealism, currently mirrors the lawlessness of the Wild West.

Its streets resemble an open-air drug den, overrun by homeless encampments. Tents block streets and parking, making sidewalks impassable for pedestrians with disabilities.

Human waste, syringes and hazardous materials spill directly on private property and in waterways, polluting them.

Open-air fires in the middle of public thoroughfares offer scenes more reminiscent of the Great Depression than the prosperous, innovative community associated with the Berkeley name.

This June, the US Supreme Court decided Grants Pass v. Johnson, a ruling that empowers local governments to enforce camping bans in public places, even if there are no alternative spaces available for campers. 

Since the decision, many elected officials have been slow to use their newfound authority to clear street encampments.

Years ago, Berkeley City Hall decided that it would handcuff its police force, restricting officers from enforcing laws like those against public nuisances that are designed to protect the health and safety of those living and working in the area.

Streets today are so unsafe that city staff often refuse to deal in-person with the issues created by these policies, one city representative going so far as to suggest this author carry a gun.  

Nearly 500 days ago, the Berkeley City Council gathered to receive feedback from the community.

Only half of the council bothered to visit the adjacent encampment before hustling inside.

After innumerable emails, calls, public meetings, photos and pleas for help from hundreds of Berkeley stakeholders, the council failed to authorize city workers to clear tents and RVs.

Despite eventually claiming they were waiting for the Supreme Court to decide Grants Pass before acting, some of Berkeley’s leaders immediately rebuked the decision and stressed the need to maintain the status quo.

Ironically, the property that hosted that first community meeting was recently damaged by an out-of-control encampment fire. 

Gov. Gavin Newsom, despite filing an amicus curiae brief in Grants Pass in favor of greater enforcement powers and his recent calls for “no more excuses” to remove homeless encampments, didn’t help either.

In response to a request for help, his office responded that funding for cleanups and care for those who desperately need safer and more compassionate living arrangements must come from Alameda County, not the state.

The county, in turn, claimed that it had no funding and pointed to financially strapped Berkeley as the responsible entity.

Those local residents and business owners have repeatedly tried to offer humane and practical solutions.

California Gov. Gavin Newsom suggested he would enforce clean-up mandates, but has failed to adequately tackle Berkeley’s homeless problem, critics argued. AP

They waited nearly two years for City Hall to relocate illegally parked RVs to a leased lot which could provide health services.

Fed up with the city’s lack of motivation and success, a group of residents identified a comparable site within weeks, at an annual cost of $200,000.

City Hall declined the offer, saying, “We are now flat broke.”

Meanwhile, it gave the long-time city manager a $600,000 going-away present.

Mayor Jesse Arreguín said that he preferred to keep the proposed site for his distant future dream of medical lab space, despite no concrete plans or interest for this development.

Today, only weeds occupy the site.

In a final act of desperation to save Berkeley, business owners and other stakeholders filed a lawsuit earlier this month.

University of Minnesota law professor Ilan Wurman, who successfully sued Phoenix to clean up its notorious 1,000-person encampment known as “The Zone,” represented the plaintiffs.

Last Tuesday evening, just hours after being notified of the lawsuit, Berkeley’s council voted 8-1 to pass a new ordinance allowing city workers to remove encampments.

Though it remains to be seen whether or how Berkeley will enforce the new law, it marks a major victory for the area’s long-suffering and hard-working businesses and property owners.

While it shouldn’t have taken a lawsuit to get city leaders to finally act, the quick development should give citizens in similar situations, like in nearby Oakland, hope.

Local governments that refuse to remove nuisances from public spaces — for whatever reason — are on notice.

THIS AND THAT: Traveling surely has its own rewards, but…

Five couples who are longtime friends were together celebrating the birthday of one of the members.While the other six were at the dining room table eating, my wife and I sat with the final couple next to the kitchen munching happily on Lowcountry Boil. There are few things better than the shrimp, crab legs, corn on the cob, potatoes and sausage cooked together along with a heavy dose of Old Bay spice.In our conversation, we talked about family, retirement, friends and travel. Our friends across the table have had trips to a number of destinations, as have my wife and I. We had just returned from our trip to France, and our friends were eager to hear about it. Then came the question.After listening to a few of our French highlights, the gentleman asked, “What is the favorite place you have visited?”

My wife and I looked at each other and pondered the sites we have seen — most of them since our retirements. There have been visits to amazing places. We scanned back through the years thinking of visits to national parks in the American west — Glacier, Grand Canyon, Yosemite, Death Valley, Sequoia among them.

There were trips to Alaska where we had a whale of a time and were enthralled with our nation’s largest state. A visit to Maine with a pair of grandchildren was fascinating as we dined on lobster and went whitewater rafting.Cruises have taken us places we never would have dreamed as younger adults. London, Paris, Istanbul and Athens were only names in history books and places on maps until we were there in person. Scotland is my ancestral nation (think William Wallace and “Braveheart”) and felt more like home only when I ate haggis in Edinburgh and stood on the shore of Loch Ness (but we saw no monster in the water!).

Norway and Iceland were favorites, the former because of its beauty, the latter by virtue of its unusual terrain and reliance on geothermal energy.

But a favorite? Now that was seemingly a hard answer to reach, because all of those and others had special appeal for us. Then the answer came to me as it did to Dorothy in “The Wizard of Oz.” There’s no place like home.

“Aiken,” I said in reply to the question of the favorite place we have been. “Right here at home.”While travel has its benefits and is eye opening, there is a lot to be said for sleeping in a familiar bed, knowing exactly where the bathroom is at 3 a.m. and pulling out the day’s clothing without rummaging through a suitcase.

Being able to get into our car at a moment’s notice and drive where we want without having to wait for a train, bus, taxi or plane is something we take for granted. Getting around our hometown and not having to rely on a map or GPS system to find our destination is a blessing.

Foraging through the fridge late at night for food I know I’ll like is preferable to the fare offered at the front desks of hotels in the U.S. or abroad. When at home, I can turn on my TV with a click of the remote and find programs of choice with ease. That is not normally the case on out-of-town trips with foreign remotes and indecipherable directions.Friendly faces in the neighborhood and behind the counters of local shops is preferable to entering a store and wondering if the shopkeeper speaks English or comprehends my broken (very) French.While taking cruises and awakening to new vistas every morning is nice, I’m a guy who likes two feet on the ground and the reliability of knowing that the view from my front window is never changing. Call me boring, and that’s OK. Home sweet home — there’s nothing quite like it.
